Melbourne will make a last-ditch bid to free Jacob van Rooyen for their looming finals campaign as they head to the AFL Appeals Board and fight his three-game striking ban. Live below from 5:30pm!

van Rooyen was successful in a similar case at the Appeals Board three years ago, with the Demons finding an error of law when he was banned for striking while attempting a spoil.

It's likely Melbourne will consider making the same argument this time after van Rooyen's three-game striking ban was upheld by the Tribunal on Tuesday night.

At the Tribunal, the Demons pointed to the rules around marking contests which state "a player whose sole objective is to contest or spoil the mark be permissioned to do so", and "there is a reference to permitted contact".

But in their reasons the Tribunal stated: "The video evidence is quite inconsistent with van Rooyen continuing to intend to mark the ball at all times prior to and at the moment of impact.

"This disposes of the argument on behalf of Van Royen that 18.5.3, the effect that this could not be a reportable offence because Van Rooyen's sole objective was to contest the mark.

"In any event, Law 22.2.1(b) makes clear that, notwithstanding any other provision in the laws, in all circumstances, a player owes a duty of care not to engage in conduct which will constitute a reportable offence being committed against that other player, to take reasonable care to avoid acts which can be reasonably foreseen to result in a reportable offence.

"Even if it was Van Rooyen's sole objective at all times to contest the mark, we find that he did so in a way that failed to take reasonable care to avoid acts which could be reasonably foreseen to result in a reportable offence."

In 2023, the Appeals Board backed the Demons' view on law 18.5.

The Demons could also raise the Tribunal refusing to allow evidence from a biomechanist, which the club believed proved there was not enough time for van Rooyen to move his arm out of the way of the contact.

The Tribunal read the report but did not permit it into the hearing, with chair Jeff Gleeson saying it was "not sufficiently probative, or really probative at all" due to concerns with its precision.

As it stands van Rooyen will be unavailable for Round 24 plus Melbourne's first two finals matches, likely an elimination final and a potential semi final.

The Appeal Board hearing gets underway at 5:30pm AEST. Follow live updates below!
